“Representatives of Mashpee Commons appeared before the Mashpee Zoning Board of Appeals last Wednesday, July 13, to begin the administrative review process to build 127 housing units in accordance with its Chapter 40B Comprehensive Permit.
The Commons received its comprehensive permit for 382 residential units on 58.5 acres of land off Job’s Fishing Road from the ZBA in 2007, under the state’s Chapter 40B statute.
Chapter 40B allows local zoning boards to approve housing developments that bypass local zoning regulations as long as 25 percent of the residential units in the development are deemed affordable. ZBAs can approve 40Bs if the town’s affordable housing stock is less than 10 percent of the town’s total housing stock.

The most recent calculation of Mashpee’s housing stock deemed 5.3 percent as “affordable,” town planner Evan R. Lehrer told the Enterprise. However, this statistic is two years old and based off the 2010 census, he said.
Given the increase in total year-round housing units in Mashpee—without a significant increase in affordable units—Mr. Lehrer said he expects the percentage of affordable housing in town to decrease the next time it is calculated on more-recent data.
Since 2007, 32 of the Mashpee Commons total 382 permitted 40B units have been built, eight of which are affordable. The 127 units to be built over the next few years are part of the first phase of the 40B development, which will have a total of 179 units once completed.
Now, after a three-party development agreement among the Commons, the Town of Mashpee and the Cape Cod Commission fell through last fall, the developers have shifted their attention back to the existing 40B permit and are fast-tracking an ambitious plan to build 127 of the 40B residential units over the next three years.
If all goes according to plan Mashpee Commons will break ground on these units later this year, Commons partner Sarah Chace told the Enterprise.
Ms. Chace and Mashpee Commons director of planning and construction Thomas Feronti said they have sped up the process to help with the housing crisis on Cape Cod.
“We’re recognizing the need to get heads in beds as quickly as possible,” Mr. Feronti said.
Of the 127 residential units the Commons developers plan to build, 32—or 25 percent—will be affordable.
To ensure that developers are building affordable housing simultaneously with the market-rate units, Chapter 40B requires that for every 40 market-rate units, the developers build 10 affordable units.
The state regulation also requires that the affordable apartments do not have a different “feel” to them, Ms. Chace said.
The Commons development team hopes to have tenants in the new apartments 16 to 18 months after ground is broken on the project, Ms. Chace said.
“Affordable” is defined by the state’s housing authority, according to Mr. Feronti. For a person to qualify for an affordable unit at the Commons, the person cannot earn more than 80 percent of the area median income, or AMI…”
