Any rational person would conclude, based on the record, that a truly exceptional and unique set of geotechnical, architectural/engineering, political, and other factors have converged to bring about this spectacular phenomenon... and would withhold judgment until the case is litigated in a San Francisco court and the various experts for plaintiff and defendant have a chance to take the stand.

One good thing is once this is demolished it becomes even more of an eye sore right in the middle of downtown. That should help expedite the process because nobody wants another hole downtown and hopefully this thing moves forward uninhibited from this point forward on whatever schedule its on currently.
 
The buzz in the city of Boston is Amazon will announce Winthrop Square garage location is the 2nd home to Amazon work force.
Expect this project to get fast tracked now. Labor costs are going to skyrocket now with this and the casino now in play.

This tower along with Amazon being in this part of downtown is going to be insane.

Great fit and addition to this area.

Always thought the Suffolk downs location was an awful idea. They should build rental or condo units to help the affordable housing in and around Boston.

Is Revere a sanctuary city also?

I do have a question:

I'm not sure how building a tower is legally structured concerning ownership. But since the Millennium Group is getting sued in San Fran concerning that tower.

Could that prevent them from building this Winthrop Garage Tower from being completed if the plaintiffs were able to win the case and demand their money back along with paying for damages force the group into a bankruptcy process?

Is Millennium Group at risk here because of the San Fran tower problem?

I will leave the critique of Rifleman's post to others... but this post is spot on. Millennium got screwed by subcontractor Webcor, City of San Francisco engineers and their 3rd party consultant... Webcor and City of San Francisco will be picking up most of the tab for this fiasco.

Furthermore, Millennium Partners' holdings and future projects are well removed and legally insulated from the fallout, whatever that should be from the final resolution of MT San Francisco.

Major commercial and residential real estate projects are isolated from the development groups in separate LLCs for exactly this reason. Liability is limited to the investors in the specific project, not the Millennium Group as a whole.

Unless someone is making a criminal case about conspiracy or negligent fraud (not civil lawsuits, criminal indictments from the State of California), I am not aware of a mechanism to pierce the corporate liability protections of an LLC.

No company can make assurances that they are isolated completely from financial downturns or unexpected events. Developers are constantly being sued; it is why they use the separate LLCs for projects. They are big targets.

I get that developers get sued constantly .
The question is how unique is the San Fran Case? How many other developers got sued for foundation issues concerning one development that possibly affected future developments because of civil/fraudulent cases?

The homeowners association to the San Fran building is suing the developers.

I think there is a lot of risk concerning this group and if the judge finds for the homeowners association for financial damages or the building is deemed to be knocked down several stories could cost hundreds of millions of dollars.
I would think the developer would consider bankruptcy especially if the insurance company had a loop hole out .

How would that affect Winthrop Square Garage if the building was in the phase II of construction?

He was never technically banned to begin with. Briv wouldn't allow it. Instead he took a (very) temporary leave of absence from the site.
