The envoy in the seaport is the same. A fall is a fall, they're both pretty high up.
The skylobby lounge in this is going to be another huge asset to the every improving city.
Is this first picture just an interior rendering with the view from Top of the Hub photo shopped in the background? I mean, I know they're cracking down on drones so it may not be too easy to get an accurate image, but that's not what the view will look like from the skylobby at all.

The Envoy roof is fantastic, good luck trying to get up there Thursday - Sunday from May through September. We really could use more outdoor drinking options in Boston.
And looking at data's markup of the facades bordering Dartmouth and Stuart streets, there is no terrace, given that the sun typically sets in the west.

The Envoy is five stories up. There is also a (smallish) ledge.
The greatest risk/liability is that a passer-by will be struck with an object (doesn't have to be a falling body) that originated from this terrace. If the terrace is not above a street/alley, the potential risk is substantially less.
